NOTICE OF TAX SALE
Under and by virtue of an Order of Sale directed, delivered and issued out of the District Court of Douglas County, Kansas, Division No. 1, Case No. 11 C 373 in which the Board of County Commissioners of Douglas County, State of Kansas, is Plaintiff and the several persons whose names are hereinafter listed and appear preceding the legal descriptions of the property to be sold are Defendants, I will, on the 6th day of March, 2012, at 10:00 a.m., offer at public auction in the Jury Assembly Room, basement of the Douglas County Judicial and Law Enforcement Center, 111 E. 11th Street, Lawrence, Kansas, and sell, free and clear of all unpaid tax liens and special assessments to the highest and best bidder for cash in hand, all of the following described real estate situated in Douglas County, Kansas:

Said real estate will be sold to satisfy a lien for delinquent taxes, charges, penalties, interest, and costs in the amounts as set forth following each of the above tracts of real estate, as above described, said lien for delinquent taxes, charges, penalties, interest, and costs having been determined and assessed by judgment of the above-described tracts of real estate. The real estate described in each of the items above set forth designated as a separately numbered cause of action will be sold separately.

The above-described real estate is to be sold without appraisement, and if such sale for want of time cannot be completed on the stated day, it shall be adjourned from day to day until completed. The real estate will be sold subject only to real estate taxes for 2010 and subsequent years, and shall be subject to valid covenants running with the land and to valid easements of record in use, if any there shall be.

No tract, lot, or piece of real estate offered for sale shall be sold, either directly or indirectly, to (1) any person interested in any tract lot or piece of real estate as owner or holder of the record title, his or her heirs, devisees, executors, administrators, or assigns; (2) any person who held an interest in a tract as owner or holder of the record title at any time when any tax constituting part of the County's judgment became due; (3) any parent, grandparent, child, grandchild, spouse, sibling, trustee, or trust beneficiary of a person enumerated in Paragraph (2); (4) with respect to a title holding corporation, any current or former stockholder, current officer or director, or any person having a relationship enumerated in Paragraph (3) to such stockholder, officer, or director; or (5) any person that is the record owner of other real estate upon which there are delinquent taxes of a general ad valorem tax nature or delinquent special assessments in existence as reflected by the records of the Douglas County Treasurer. Any purchaser of any tract of said real estate shall file with the Clerk of the District Court, an Affidavit stating that the purchase of the real estate was not made directly, or indirectly, for any person prohibited from purchasing.

Provided, that in the event the highest bid of any tract, lot, or piece of real estate above-described does not equal the delinquent taxes, charges, penalties, interest, and costs charged to it, the Sheriff may, at the discretion of the Board of County Commissioners, bid in said tract, lot, or piece of real estate in the name of the County.

Provided further, that the terms of the sale shall be cash or certified check. Successful bidders must pay the total amount due in cash or by certified check within two hours of the end of the sale.

Information for Bidders


  1. All bidders must register and obtain a number to be used during the auction. Registration of any a partnership, limited liability company, corporation, trust, or other entity must disclose all of the partners, officers, directors, stockholders, members, trustees, beneficiaries, and other owners, as applicable.
  2. Do not register under any name but your own. All bidders must be present in person to bid at the auction.
  3. No tract, lot, or piece of real estate offered for sale shall be sold, either directly or indirectly, to: (1) any person having a statutory right to redeem any tract lot or piece of real estate prior to such sale as owner or holder of the record title, his or her heirs, devisees, executors, administrators, or assigns, except any person or such person's assignee who held an interest as a mortgagee of record at the time of sale; (2) any person who held an interest in a tract as owner or holder of the record title at any time when any tax constituting part of the County's judgment became due, (3) any parent, grandparent, child, grandchild, spouse, sibling, trustee, or trust beneficiary of a person enumerated in Paragraph (1); (4) with respect to a title holding corporation, any current or former stockholder, current officer or director, or any person having a relationship enumerated in Paragraph (3) to such stockholder, officer, or director; or (5) any person that is the record owner of other real estate upon which there are delinquent taxes of a general ad valorem tax nature or delinquent special assessments in existence as reflected by the records of the Douglas County Treasurer. Basically, if you have had some connection with the sale property when the taxes became due, do not bid before checking your eligibility to buy. Successful bidders must complete an Affidavit evidencing qualification, the form of which is available to review prior to the auction.
  4. If, within a period of 10 years after the auction, you sell, give or convey any property purchased at this sale to any person who is not eligible to purchase at this sale, you may be liable for an amount equal to the tax judgment lien and interest thereon from the date of this sale. (K.S.A. 79-2804g(c))
  5. Terms of the sale: CASH OR CERTIFIED CHECK. The total amount due must be paid within two hours of the end of the sale.
  6. The real estate will be sold free of all 2011 and prior year's taxes and special assessments. The purchaser will be responsible for payment of all taxes and specials for 2012 and subsequent years.
  7. The sale is for real estate only. The sale does not include personal property left on the premises. If there is personal property upon the premises, you may wish to seek the advice of your attorney regarding your rights to it.
  8. A Sheriff's Deed will be issued in the name of the successful registered bidder only. A Sheriff's Deed is similar to a Quit Claim Deed and marketable title is not guaranteed. The title acquired is only as good as the legal procedures of the suit and sale – no warranties are given. The property remains subject to valid easements, covenants, restrictions of record.
  9. An additional $12 fee will be collected from each purchaser for each tract, to be applied on the recording fee charged by the Register of Deeds. Your deed (or deeds) will be filed directly with the Register of Deeds on your behalf after the sale has been confirmed by the Court. After recording, the original deed will be forwarded to you at the address you provide at the registration desk. Expect three to four weeks before the Court confirms the sale and your deed is filed with the Register of Deeds.
  10. Douglas County, Kansas, the Douglas County Treasurer, the Board of County Commissioner of Douglas County, nor any of their agents, make any representation concerning the value, quality, condition, or potential of property offered for sale. Property is sold AS IS, with no warranties whatsoever, either express or implied. The purchaser should make any such determination independently of these proceedings.
